Elderly Care Negligence
If you have suffered injury due to the negligence of a care provider, or your elderly relative has, please contact us at John Mickelson Law Corporation. We can provide clear legal advice during this troubling time.
Negligent elderly care
Seniors are particularly vulnerable members of society. To minimise abuse, there is widespread legislation surrounding the care of elderly people.
Assisted living facilities, for example, must register with the assisted living registrar. These facilities must then operate in a way that does not endanger the health and safety of its residents.
If care is only provided to one or two persons, a license is not needed. Otherwise, a facility will be in breach of the rules.
If a care provider does not adhere to the relevant legislation, causing an elderly person to suffer harm, it could amount to negligence. This means the person or organisation has failed to meet their duty of care, be it deliberately or accidentally. Either way, the injured person could be in a position to sue.
Elderly care providers may be deemed negligent if someone under their care is hurt due to –
- Abuse
- Untrained staff
- The lack of an emergency response system
- Unsafe premises
- The lack of supervision
Suing elderly care providers
To find out if you have grounds to sue an elderly care provider, please contact us for advice. The injury may have affected you, or it may have affected someone close to you, such as a spouse, family member or friend.
We know that it can be difficult to establish what really happened, especially if you are acting on behalf of a loved one with diminished mental capacity.
The care provider may not admit fault, or other people might not believe your version of events.
However, please do not let this deter you. If you have been harmed through no fault of your own, or your loved one has, it is important to take action.
This will improve safety standards, preventing similar incidents occurring in the future.
Compensation for injuries
Taking legal action also allows you to claim compensation for your damages. This includes your pain and suffering, and any financial losses, such as the cost of medical treatment and rehabilitation.
At John Mickelson Law Corporation, we work alongside a network of medical professionals. We can get you the best care going forward, ensuring your short-term and long-term needs are met.
